Yoma 38 Avtinas - Gnai or not?

Question from a scholar (la dude) we just received - does anyone have an answer? Thanks


l'maysa, being that Rebbi Akiva says about beis avitnas "assur l'saper bgnoosam shel eilu" due to the fact that their witholdhing of the ketores was done l'shma, then how come the mishna lists them b'gnus, as the Mishanyos were put together by Rebbi who lived after Rebbi Akiva?

efshar that although Rebbi Akiva held it was assur to say bad things about beis avitnas, Rebbi did not agree and held that although they acted l'shma, nonetheless, it was an aveira l'shma, and they should have asked before they made this decision. L'maysa, this approach does not appear correct as the clal is we usually go like Rebbi Akiva, and it is highly unusual that Rebbi would argue in him. TI (Tzarich Iyun).

Rav Sholom Shvadron explains that although it has now become clear that they acted L'Shem Shamayim, that does not suffice. Chazal in their times felt that the correct L'Shem Shamayim would be to teach. They did not defer to Chazal's interpretation of what L'Shem Shamayim is. Therefore, notwithstanding their pure intentions, they are listed lgnai. This is a truly powerful message regarding Daas Torah and how a person can be really well-meaning but out of sync with Chazal.
